Abstract

إن د ا رسة دفتر الشروط في الصفقات العمومية في التشريع الج ا زئري، أوصلتا إلى أنو يرتبط ارتباطا وثيقا بعقود الإدارة فلا يمكن للمصلحة المتعاقدة أن تبرم الصفقة إلا بدفتر الشروط الأمر الذي يؤكد أن قواعده القانونية ملزمة المتعاقدين كما أن قواعده متعلقة بالرقابة القبلية للصفقة العمومية، كون معايير اختيار المترشح تكون مدرجة في تقوده وبالتالي احت ا رمها يؤدي إلى تطبيق مبدأ المنافسة والشفافية وترشيد النفقات الكلمات المفتاحية: الصفقة العمومية، دفتر الشروط المتعهد، المترشح، المصلحة المتعاقدة Résumé : L'étude du cahier des charges des marchés publics dans la législation algérienne, nous a conduit à penser qu'il est étroitement lié aux contrats de gestion, de sorte que le pouvoir adjudicateur ne peut conclure le contrat qu'avec un cahier des charges, ce qui confirme que ses règles juridiques sont contraignantes pour les contractants et que ses règles sont liées au contrôle tribal des marchés publics, comme critères Le choix du candidat sera inscrit dans ses clauses, et donc le respecter conduira à l'application du principe de concurrence, de transparence et de rationalisation des dépenses.
