إن الرقابة على دستورية القوانين تعد نظامًا مستحدثًا في الج ا زئر، يهدف إلى ضمان احت ا رم مبدأ سمو الدستور وصون الحقوق والحريات، وقد عرفت تطو اً ر هامًا خاصة بعد التعديل الدستوري لسنة 2020 الذي رسّخ آلية الدفع بعدم الدستورية، وتم تنظيمها بموجب القانون العضوي 22 - 19 ، حيث أصبح للسلطة القضائية دورٌ محوري في تفعيل الرقابة اللاحقة من خلال تصفية الدفوع قبل إحالتها إلى المحكمة الدستورية، مما يشكل تحولًً نحو تكريس رقابة قضائية فعالة على النصوص القانونية . Resume Constitutional review of legislation in Algeria represents a relatively recent legal development, introduced to uphold the supremacy of the Constitution and safeguard fundamental rights and freedoms. This mechanism was notably reinforced by the 2020 constitutional amendment, which institutionalized the exception of unconstitutionality as a means of posterior (a posteriori) review.
